These Terms and Conditions apply to you as a user for online ordering (hereinafter referred to as” yumdeli” “We", "Us", or "Our" and the terms “You”, “Your” or “User” refer to user of the Platform.)
These Terms and Conditions ("Agreement") govern your use of the Yumdeli platform, which connects customers to restaurants for online ordering and food delivery (the "Service"). By accessing or using the Yumdeli website, mobile app, or any other service provided by Yumdeli (collectively referred to as the "Platform"), you agree to comply with these Terms and Conditions.
The website and mobile apps is managed and operated by the yumdeli India private limited company, if you do not agree to these Terms and Conditions, you must not use the Yumdeli Platform. These terms are a legal agreement between you (the "Customer," "User," "You") and Yumdeli (the "Company," "We," "Our").
Introduction
Yumdeli provides a platform that allows you to browse food menus from participating restaurants and place orders for delivery. The service includes access to restaurant menus, order processing, payment, and delivery tracking. Yumdeli acts as an intermediary between you and the restaurants, and we are not the restaurant owner or food preparer.
The content referring to specific products arrangement and texts layout of the online ordering application and/or process, the trademarks, and any other content, are proprietary and are protected according with the legal regulations in force and cannot be used in any way without the express written permission of the company and The Company may, at its discretion, add, modify, or remove any of the Products and/or Services listed above from time to time without notice.
Eligibility to Use:
By using the Yumdeli Platform, you confirm that you:
- Are at least 18 years of age to create an account and place the orders and users (or the legal age of majority in your jurisdiction).
- Have the legal capacity to enter into a contract.
- Have a valid payment method (e.g., credit card, debit card, or mobile wallet) to complete the transaction.
- Are in a delivery area where Yumdeli services are available
Account Creation and Use
To place an order on the Yumdeli platform, you may need to create an account. When registering an account, you agree to:
- Provide accurate, complete, and current information, including your name, address, phone number, and payment details.
- Keep your account credentials secure and confidential.
- Notify Yumdeli immediately of any unauthorized use of your account.
You can deactivate your account at any time by contacting Yumdeli customer support.
Ordering and Payment
When placing an order, you agree to:
- Choose the food items: You may browse menus from various restaurants and select items for delivery. Ensure that you double-check your order before confirming it.
- Provide accurate delivery information: Ensure that the delivery address and contact details you provide are correct and up to date.
- Confirm your order: After selecting your items, you will be prompted to confirm the order, and a payment will be processed through your selected payment method.
- Payment: Payments will be processed through a third-party payment gateway. You agree to pay for all items ordered, plus any applicable taxes, delivery fees, and tips.
- COD: If you opt to make payment by Cash on delivery mode, the company shall have right to refuse delivery of the ordered products that if you fail to make the payment and the company shall treat such order as cancelled and not be liable for losses or damage that may arise on account of such non delivery to you.
Payment methods accepted on the Yumdeli platform may include, but are not limited to, credit cards, debit cards, and online wallets. By placing an order, you authorize Yumdeli to charge your payment method for the full amount of your order. All prices listed on the yumdeli platform are in local currency and include applicable taxes unless stated otherwise. Prices are subject to change without prior notice. Users will be informed of any price changes before the completion of their order. Menu prices are determined and may vary based on location, time, and availability.
Delivery
After an order is placed, Yumdeli will arrange for a delivery partner to deliver your food. The following applies to delivery:
- Delivery Time: Delivery times on Yumdeli ranges from 30 minutes to 60 minutes and we aim to deliver within the time frame provided, but delivery times may vary due to factors beyond our control (e.g., traffic, weather, restaurant delays).
- Delivery Fee: Depending on your location, the size of your order, and the time of day, a delivery fee may be charged. This fee will be clearly shown to you before you complete the order.
- Delivery Confirmation: Upon successful delivery, you will receive a notification that your order has been delivered. If you have any issues with your delivery, please contact Yumdeli support immediately.
- Failed Deliveries: If a delivery attempt fails due to incorrect information (e.g., wrong address, no one available to receive the order), you may be charged a re-delivery fee.
Customer Responsibilities
As a customer, you are responsible for:
- Providing accurate information: Including your delivery address, contact information, and any special instructions for the restaurant or delivery partner.
- Ensuring the delivery location is accessible: Make sure the delivery address is accessible to the delivery partner, and there is someone available to receive the food.
- Reviewing the order: Double-check your order, including any special dietary requests or preferences (e.g., vegetarian, gluten-free), as we cannot guarantee changes once the order is submitted.
- Responding to delivery issues: If the delivery is delayed, the food is incorrect, or there is a problem, notify Yumdeli customer support as soon as possible so we can resolve the issue.
- Reviewing the food: After receiving your order, if you notice any discrepancies (e.g., missing items, incorrect items), please report them promptly.
Pricing and Charges
By placing an order, you agree to pay:
- The price of the food items as listed by the restaurant.
- Delivery fees (if applicable), which may vary depending on the distance and time of day.
- Taxes: Applicable local or national taxes on food, delivery, or services.
- Tips: Optional tipping for the delivery partner. You can leave a tip through the platform when placing an order, or in cash upon delivery.
Yumdeli reserves the right to change prices, delivery fees, and promotions at any time, but the price you are shown at the time of ordering will be the amount you are charged.
User Conduct and Prohibited Activities
As a user of the Yumdeli platform, you agree not to:
- Abuse, harass, or harm others: This includes customers, delivery partners, restaurant staff, or Yumdeli employees.
- Provide false information: Do not provide false or misleading details, including fake names, delivery addresses, or payment information.
- Impersonate Yumdeli staff or delivery partners: Do not attempt to impersonate or mislead other users or our staff.
- Manipulate reviews or ratings: Do not submit fraudulent reviews or manipulate the rating system.
- Use the platform for illegal activities: You must comply with all local laws and regulations regarding food ordering and delivery.
Yumdeli reserves the right to suspend or terminate your account if you engage in any of the prohibited activities listed above.
Limitation of Liability
Yumdeli acts as an intermediary between you and the restaurant. We are not responsible for:
- Food Quality: Yumdeli is not responsible for the preparation, taste, or quality of the food.
- Restaurant Performance: Yumdeli is not liable for restaurant delays or food errors, but we will do our best to resolve issues.
- Third-Party Services: Yumdeli is not responsible for any actions of third-party services, including delivery partners or payment processors.
In no event will Yumdeli be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or from food deliveries, even if Yumdeli has been advised of the possibility of such damages.
Privacy and Data Protection
Yumdeli respects your privacy and is committed to protecting your personal information. Our Privacy Policy outlines how we collect, use, and protect your data. By using the Yumdeli platform, you agree to the collection and use of your personal information as described in our Privacy Policy.
Beware of fraud:
Please do not share Your debit/credit card number, CVV number, OTP, UPI/ATM pin and other sensitive information with anyone claiming to be a Company representative. Company or its authorised representatives will NEVER ask You to share the aforesaid details. Beware of fraudsters and please report incidents immediately to Your bank, the nearest police station and at https://cybercrime.gov.in/.
Please exercise caution to verify the portals/website links claiming to be yumdeli or a lookalike or a payment link shared over social media or a social messaging apps claiming to be yumdeli discounts or offers and proactive calls from unauthorised numbers requesting for personal/financial information.
You shall solely be responsible for maintaining the necessary computer equipment, gadgets and internet connections that may be required to access, use, and transact on the Platform. yumdeli will not be liable for any loss that You may incur as a consequence of unauthorized use of Your Account or Account information in connection with the Platform either with or without Your knowledge.
Company shall not be held responsible for non-availability of the Platform during periodic maintenance operations or any unplanned suspension of access to the Platform that may occur due to technical reasons or for any reason beyond the Company’s reasonable control.
Modifications to Terms and Conditions
Yumdeli reserves the right to modify or update these Terms and Conditions at any time. When changes are made, we will update the "Last Updated" date at the top of this page. Continued use of the Yumdeli platform after changes to the Terms and Conditions will constitute acceptance of those changes.
Termination of Service
Yumdeli reserves the right to suspend or terminate your access to the platform if:
- You violate these Terms and Conditions.
- There are issues with your payment or account verification.
- We believe your actions harm the integrity or security of the platform.
If your account is terminated, you will no longer be able to access the Yumdeli platform unless reinstated by customer support.
Communications:
When you sign up for an account, you are opting in to receive emails, SMS, telephone calls, messaging app like WhatsApp on the registered mobile phone number /or electronic communications like e-mails from the Company from other yumdeli users, businesses, and yumdeli itself. You can log in to manage your email preferences and follow the "unsubscribe" instructions in commercial email messages, but note that you cannot opt out of receiving certain administrative policy, service policy, or legal policy from yumdeli.
Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of the jurisdiction in which Yumdeli operates. In case of a dispute, you agree to first attempt to resolve the issue through mediation or negotiation. If the dispute cannot be resolved informally, it will be subject to binding arbitration in the relevant jurisdiction.
Advertisement:
The User must agree to the advertisements that may be placed by the yumdeli on the Service as some of the Services are supported by advertising revenue and may display advertisements and promotions. The yumdeli will not be responsible or liable for any errors or omission, inaccuracy in advertising material or any loss or damage of any sort incurred as a result of any such dealings or a result of the presence of such other advertiser(s) on the yumdeli platform we site and mobile application.
Cancellation and Refund Policy
At Yumdeli, we understand that sometimes things don’t go as planned, and we aim to provide a seamless experience for our customers, even in the event of cancellations or issues with your order. This Cancellations and Refunds Policy explains the process and conditions under which orders can be cancelled or refunded.
1. Order Cancellations
1.1. Customer Initiated Cancellations
As a customer, you can cancel an order under certain conditions. However, once an order is being prepared or before company accept the order or has been picked up by a delivery partner, it may no longer be cancelled. If user cancels his/her order after accepting order by the company, the yumdeli shall have right to charge 100% of the order value for breach of contract terms as a compensation for the damages suffered by yumdeli.
The cancellation policy is as follows:
- Before Order Processing: You can cancel your order at no charge if the restaurant has not started preparing your food. You can cancel via the app
- After Order Confirmation: If your order has already been processed (e.g., confirmed by the restaurant), You cannot cancel the order post acceptance of order.
- After Dispatch: If your order has been assigned to a delivery partner and is end route, cancellations are not permitted, as the food has already been prepared and delivery is in progress.
Restaurant Initiated Cancellations
Occasionally, restaurants may need to cancel an order due to circumstances such as:
- Unavailability of ingredients.
- Restaurant closure or operational issues.
- Issues with order preparation.
In these cases, Yumdeli will notify you immediately, and you will be provided with the option to:
- Choose an alternative restaurant or item (if available).
- Request a refund (if no alternative is available).
Refunds
If an issue arises with your order (such as incorrect food, late delivery), you may be eligible for a refund or credit. Refund requests are subject to the following conditions:
2.1. Refund Eligibility
Refunds will be processed based on the following scenarios:
- Incorrect or Missing Items: If your order is incomplete, contains the wrong items, or is prepared incorrectly (e.g., wrong toppings, allergies not respected), we will issue a full refund or provide the correct items if possible.
- Late Delivery: If your order is delayed beyond the estimated delivery time without prior communication, you may be eligible for a partial or full refund depending on the situation. A delay is considered significant if it exceeds 60 minutes past the estimated time of arrival.
- Food Quality or Safety Concerns: If the food is spoiled, undercooked, or not delivered in a safe condition, you will be eligible for a full refund or credit. You must report the issue immediately to Yumdeli support for investigation.
- Restaurant Cancellations: If the restaurant cancels your order (as described in Section 1.2), you will be issued a full refund for the entire order.
- It is hereby clarified that no exchange or returns shall be accepted if the product packaging is opened or product is used/consumed either in part or otherwise.
Non-Refundable Scenarios
Refunds will not be issued under the following conditions:
- Change of Mind: If you change your mind after the order has been confirmed, we cannot offer a refund once the restaurant has started preparing the food.
- Incorrect Delivery Details: If you enter incorrect delivery information (e.g., wrong address or phone number), and the delivery partner cannot reach you or make the delivery, no refund will be provided. You will be charged for the delivery attempt.
- Customer Unavailability: If you are not available to receive the order at the provided delivery address, or if the order cannot be delivered due to customer error (e.g., no one available to accept the delivery), no refund will be issued. In this case, the delivery fee and full order cost may still apply.
Refund Process
To request a refund, please follow these steps:
- Contact Customer Support: Reach out to Yumdeli Customer Support through the app, email, or phone within working hours of receiving your order. Provide your order number, details of the issue (e.g., missing items, late delivery), and any supporting documentation (e.g., photos of damaged food or incorrect items).
- Investigation and Resolution: Our customer support team will review your request and may contact the restaurant or delivery partner for clarification. We aim to resolve refund issues within 3-7 business days. You will be notified of the resolution via the platform.
- Refund Issuance: If your refund is approved, it will be issued to the same payment method used for the original purchase (credit/debit card, mobile wallet, etc.). Refunds may take 3-7 business days to appear in your account, depending on your payment provider.
- Credit for Future Orders: In some cases, instead of a refund, we may offer credit to your wallet account to be used on a future order. You can choose to apply the credit at checkout when placing your next order.
- Important Note: The users shall verify his/her Order before providing OTP to the delivery partner and any issue with respect to the orders shall be notified immediately, and the cancellation request shall be placed before providing OTP to the delivery partner. Once OTP is provided it shall be deemed that the user has accepted delivery of his/her order, the user cannot cancel the Order and/or claim refund.
- Genie’s Cancellation: Cancellation of Pickup & Drop Order after delivery partner has reached the location but has not picked up the items may invite a cancellation fee in the range of 20 to Rs.60 (Based on the base deliver fee in the city).
Cancellations and Refunds for Subscription or Promo Orders
If you are using a promotional offer, discount, or subscription service (such as a loyalty program or bulk order discount), cancellations or refunds may affect the value of the promotion. Refunds in these cases will be processed as follows:
Partial Refunds: If you have used a promotional discount and are entitled to a partial refund (e.g., if part of the order was correct), the refund will be adjusted to account for the promotional discount applied.
Subscription-based Orders: For recurring orders (e.g., weekly meal plans), cancellations of specific orders are subject to the terms outlined in the subscription agreement. Refunds for these orders will be handled on a case-by-case basis.
Force Majeure
Yumdeli is not responsible for delays or failures in order fulfilment caused by circumstances beyond our control, including but not limited to:
- Natural disasters (e.g., floods, storms, fires).
- Severe weather conditions.
- Unforeseen supply chain disruptions (e.g., ingredient shortages).
- Delivery service disruptions (e.g., vehicle breakdowns, traffic accidents).
In these cases, Yumdeli will not issue a refund, but we will work with you to resolve the issue in the best possible manner, such as rescheduling your delivery or offering alternative solutions.
Modifications to the Cancellations and Refunds Policy
Yumdeli reserves the right to modify or update this Cancellations and Refunds Policy at any time. We will notify you of significant changes via email or in-app notifications. Continued use of our platform after changes are made constitutes acceptance of the updated policy.
This document is an electronic record and published in accordance with the provisions of the Information Technology Act 2000 and as well as The Consumer Protection Act 2019, and the rules made thereunder, the grievance redressal mechanism, including the contact details of the Grievance Officer is given herein below, and generated by a computer system and does not require any physical or digital signatures.

For any order related issue, You may also write to support@yumdeli.in or you may reach out to Us via chat support on the App for real time basis resolution. The Grievance Officer of the Company shall endeavour to acknowledge the User grievances, or complaints or concerns with respect to the Platform, the Content, or the supplies, within 48 hours of receipt of the same and shall endeavour to redresses the same at the earliest and in no event later than 30 (thirty) days of receipt of such request.
